Emerald Club® Master Rental Agreement and Program Rules and Conditions


A.   General

  1. This Emerald Club Master Rental Agreement and Program Rules and Conditions (“Agreement”) consists of the following parts: (a) the Emerald Club Program Rules and Conditions as set forth in Section B below, (“Rules”); (b) your Master Rental Agreement General Terms and Conditions as set forth in Section C below (“Terms”); (c) your Master Rental Agreement Profile (“Profile”), (d) National’s rental policies that pertain to each rental as in effect at the time you rent a vehicle (rental policies may be found at www.emeraldclub.com or at the renting location), and (e) the receipt and any other documentation provided to you at the time of rental, in each case as revised from time to time, all as incorporated herein by reference and made a part of this Agreement.

  2. The Agreement is between the renter signing it (“you” and “your”) and the subsidiaries of Enterprise Holdings, Inc., as listed in Section C, Paragraph 23, below, or, in Canada, Enterprise Rent-A-Car Canada Company, or an independent National Car Rental licensee (“Licensee”), or any of their successors and/or assigns (collectively, “National”). This Agreement shall only apply to and cover vehicle rentals by National to a Customer from a rental facility which is operated under the “National” or “National Car Rental” brand name and shall not apply to or cover vehicle rentals under the “Alamo”, “Alamo Rent A Car”, or “Enterprise Rent-A-Car” brand names except as set forth in Section B.9.

  3. By using the Program membership card National sent or will send to you (“Card”) or by renting a Vehicle under the Program, you agree to all of the terms and conditions of this Agreement, including the Terms and the Rules, which are made a part of every rental of a private passenger motor vehicle (each a “Rental”) made by you through the Program.

  4. You agree to provide National with true, current and accurate information, including name, address, telephone number, and email address. You agree to notify National if you change any of the information contained in your profile and immediately if your Card or any credit card listed in your Profile is (a) lost, stolen or invalidated, or (b) or you suspect that it is being used without your permission, or (c) expires. You agree that it is your sole responsibility to notify National of any such changes and National is entitled to rely upon any information and all information provided by you and contained in your profile as being current and accurate.

  5. National may, from time to time, give you: (a) written notice of changes to the Agreement, or (b) an Internet website address where the revised version of the Agreement can be found. You may decline such changes by discontinuing rentals under the Program. You may also obtain a free copy of the latest version of the Agreement by calling 1-800-962-7070, Monday through Friday, 9:00 am - 6 p.m. EST. You agree to abide by such changes on any rental made under the Program after such notice is given. By using the Program, you agree to form a contractual relationship with National using electronic means. To the fullest extent permitted by applicable law, this Agreement and any notices or other communications regarding your account and/or your use of the Program (“Communications”), may be provided to you electronically and you agree to receive Communications in an electronic form. Electronic Communications may be delivered to the last electronic mail address on file with National. All Communications in either electronic or paper format will be considered to be in "writing," and to have been received no later than five (5) business days after dissemination, whether or not you have received or retrieved the Communication. Although we reserve the right, but assume no obligation to provide, Communications in paper format to you using your most recent address on file with National, you expressly agree that any notice due under this Agreement may be given in email form to the email address provided by you and on file with National. Without limiting anything contained in Section 4, you expressly agree that it is your sole responsibility to keep your email address current and up-to-date and that National may reasonably assume that any email sent by National to the email address on file will be received by you. Your consent to receive Communications electronically is valid until you revoke your consent by terminating this Agreement.

  6. National and/or its agents will provide to you certain transactional emails as a benefit of membership. Transactional emails may include but are not limited to the following: (a) reservation confirmations for reservations made on any of our public websites, (b) reservation reminders for reservations made on any of our public websites (c) thank you emails for reservations made on any of our public websites, (d) a monthly statement detailing your rental activity and award accruals, (e) arrival alerts containing directions and pertinent information, (f) return alerts confirming your return time and providing pertinent information regarding your return location, (g) tolls and charges, and (h) notification of an expired drivers license or credit card. Members can choose to opt out of certain of these transactional communications by signing in on www.emeraldclub.com or by calling by calling 1-800-962-7070.

  7. All information provided by you to National, whether as a result of enrolling in the Program or otherwise, is subject to the terms and conditions of National’s privacy policy, which is available at www.nationalcar.com , and at www.nationalcar.ca for Canadian rentals (the “Privacy Policies”). National reserves the right to amend either or both of the Privacy Policies, from time to time, in its sole discretion. In the event of a change to a Privacy Policy, National shall provide notice to Members in the manner set forth in the applicable Privacy Policy. Some National locations in the U.S. and Canada, are owned and operated by independent licensees that are not controlled by us or our Affiliate companies (“Licensees”). National does not control the use of any personally identifiable or payment information collected by its Licensees. Licensees are required to identify themselves (i.e., at their locations and in their agreements, sales materials, business cards, marketing materials, advertisements and other National branded materials) as “An Independent National Car Rental Car Rental Licensee” or by other similar terms. Each Licensee maintains its own privacy policy (“Licensee Policy”) and National is not responsible for the information practices of any Licensee and you agree that National shall not responsible or liable for any use or disclosure of your information by any such Licensee. Members are responsible for checking the Privacy Policy and/or the Licensee Policy applicable to you periodically. If you disagree with any of the terms and conditions of the Privacy Policy and/or the Licensee Policy applicable to you, you may instruct National to cancel your enrollment in the Program at any time as your sole and exclusive remedy. Continued participation in the Program or failure by a Member to terminate enrollment in the Program or provide National with notice of non-renewal prior to each applicable Renewal Date shall constitute consent and assent by such Member to the terms and conditions of the applicable Privacy Policy. Upon termination of enrollment in the Program, you agree to be solely responsible for contacting any applicable Licensee to delete your information.

B.   Emerald Club Program Rules and Conditions

  1. Because of the nature of the services offered in the Program, you must be at least twenty-one (21) years old to enroll as a member (upon National's acceptance of such enrollment, you are a "Member" of the Program.) If you are not twenty-one (21), you cannot enroll in the Program.

  2. Program membership does not guarantee your ability to rent vehicles from National. All Rentals remain subject and subordinate to availability and National's normal qualifications and rental conditions.

  3. Membership in the Program commences on the date of your enrollment (“Enrollment Date”) and remains in effect until 11:59:59 p.m. Central Standard Time on December 31 of the same calendar year (the “Initial Term”). Thereafter, you shall be automatically re-enrolled in the Program (each a “Renewal”) for subsequent 12 month terms (each a “Renewal Term,” and together with the Initial Term, the “Term”) at 12:00:00 a.m. Central Standard Time on January 1 of the following calendar year (the “Renewal Date”) provided you: (a) have completed at least one vehicle rental with National during the immediately preceding calendar year; and (b) you have not requested that National terminate your enrollment in the Program prior to the applicable Renewal Date. Each Renewal shall be subject to the Emerald Club Rules incorporated herein by reference and posted at www.emeraldclub.com of the applicable Renewal Date. It is the responsibility of each individual Member to inspect the Emerald Club Rules prior to each Renewal Date and accept such responsibility and release National from any responsibility or liability in connection therewith. Notwithstanding the foregoing, National, in its sole discretion, reserves the right to not renew any Member’s enrollment in the Program or to terminate a Member’s enrollment at any time for any reason. Such disqualification is effective when it is entered into the National computer system, and National shall provide notice to such terminated or non-renewed Member, in accordance with Section A, Paragraph 5, of the Rules as set forth above.

  4. Qualifying Rentals : Members attain their Membership Level (described below) based upon the number of qualifying vehicle rentals. A “qualifying vehicle rental” is defined as the number of vehicle rentals with, or the number of days they rent, a vehicle from National Car Rental locations and all participating Enterprise Rent-A-Car brand locations in each calendar year in the fifty (50) US States, Puerto Rico, or Canada (“Rental Frequency Information”). A qualifying rental does not include (and credits will not be issued) on the following type of rentals: rentals on rate plans for accounts that do not allow employees to participate in award programs; insurance replacement rentals; dealer replacement, body shop or fleet replacement rentals; rentals by employees of Enterprise Holdings, Inc. or its affiliates or subsidiaries, licensee and licensee employees booked under an employee discount rate; or when a member chooses to receive mileage, credits or points for a frequent traveler program (such as, but not limited to, an airline frequent flyer or hotel points program) or members enrolled through our Drive Alliance Partnership with Enterprise Rent-A-Car who are earning Enterprise Plus points .

  5. Member will be re-tiered periodically throughout each calendar year based upon revised Rental Frequency Information. As Members qualify for a New Membership Level, National will send materials based on the higher Membership Level. In February, National will send new materials to each Member whose account activity in the prior year was insufficient to maintain their Membership Level. Members who enrolled through our Drive Alliance Partnership with Enterprise Rent-A-Car will receive tier qualification information from Enterprise Rent-A-Car.

  6. As a benefit of enrollment in the Program, Members may choose to earn frequent flyer miles from one of the many National airline partners (each a “Frequent Traveler Program”). Frequent flyer miles are not available for Enterprise Rent-A-Car brand rentals or to members who enrolled through our Drive Alliance Partnership with Enterprise Rent-A-Car. In the event that you enroll in a Frequent Traveler Program, you hereby authorize National to collect a Frequent Traveler surcharge to offset a portion of the administrative and program costs arising from our participation in these frequent traveler partner programs. You acknowledge and agree that you may also be subject to additional restrictions, charges, and rules imposed by each airline’s own Frequent Traveler Program rules. A list of the Frequent Traveler surcharges collected by National is available at www.nationalcar.com. The service charges may be in addition to any other fees or charges the airline may impose in connection with your use or redemption of any earned miles. You are solely responsible for understanding and complying with the rules, restrictions or terms and conditions imposed by an airline in connection with such airline’s Frequent Flyer Program.

  7. Members who choose to earn vehicle rental credits will receive one credit for each vehicle rental (for the first seven (7) days) plus an additional credit on such rental for every four (4) consecutive days of vehicle rentals in the US, Puerto Rico, or Canada. Consecutive, multiple or overlapping rentals in the same location do not qualify for rental credits. Credits will be issued at the completion of each rental. Credits will be electronically stored in the Members' Program account and will, depending upon Membership Level, be automatically converted to free days as follows:

    Free days do not qualify for rental credits but will qualify toward membership levels. Free day(s) may be used electronically when reserving a vehicle on www.nationalcar.com or Member may call 1-800-CARRENT (1-800-227-7368). No paper certificates will be issued for free day(s). Free day(s) can only be used on reservations at participating locations in the US, Puerto Rico, and Canada. Free days are combinable up to seven (7) days maximum on one rental. Members may redeem free days for periods of no longer than seven (7) free Rental Days per rental transaction. Rental credits and free days are non-transferable. These free rental days do not include (i) taxes, assessments, use fees or other governmentally imposed, authorized or permitted surcharges or pass-throughs, (ii) license recoupment fees, airport fees and concession recoupment fees, (iii) service charges and fees, (iv) vehicle license recovery fees, (v) damage waiver, the cost of optional insurance products, fuel charges, optional upgrades, underage driver's fees, infant seats or other optional items, or (vi) charges or drop-off charges for one way rentals. Payment for each of these items shall be the sole responsibility of the Member. Member is responsible for all fees and taxes Member's credits remain valid so long as such Member retains membership in the Program. Free days will expire on December 31 of the year following the year in which they were earned. Members entitled to a free day at a given size vehicle may use that credit as partial payment for a more expensive vehicle class. Free Days are redeemable for passenger vehicles only. Members who enrolled through our Drive Alliance Partnership with Enterprise Rent-A-Car cannot earn rental credits through National. Members who enrolled through our Drive Alliance Partnership with Enterprise Rent-A-Car should refer to their Enterprise Plus account at enterpriseplus.com to review rental activity and any applicable earned points for said rentals at participating Enterprise or National locations.

  8. Emerald Club Executive and Emerald Club Executive Elite Members will be charged the rate for the next lower car class when renting a full-size through luxury vehicle (excluding specialty vehicles) from National in the US and Canada.

  9. If requested when reserving a vehicle by any Emerald Club Member who (a) has established a business rental account with National or EAN Services, LLC on behalf of National and has been issued a valid business rental CID number and (b) has a completed Profile with coverage preferences selected, National will deliver or cause to be delivered a rental vehicle to any Fixed Based Operator airport facility ("FBO") located within 50 miles of a National facility. The delivery of a rental vehicle to an FBO is subject to: (a) payment of any delivery and collection fee, (b) payment of a no-show fee if such Member fails to show up for such reservation, (c) the individual FBO rules and regulations regarding delivery of rental vehicles and (d) all other applicable Rules and Terms of this Agreement shall apply to the rental and use of any such vehicle delivered under this Section. You agree that National, at its option, may service the delivery of vehicles to an FBO under the Enterprise Rent-A-Car brand name only for rentals set up with your corporate CID number. You agree to pay for either brand that services the rental. Certain optional products you selected in your profile may not be available or may be provided through different insurers or with different coverage limits or benefits. You agree that similar products provided by Enterprise Rent-A-Car brand shall replace such products provided for in your profile to the extent they are available. Notwithstanding the foregoing, such rental shall otherwise be deemed a National rental subject to the terms of this Agreement. You agree that the terms and conditions of the Enterprise brand rental agreement shall apply only to the extent of any required disclosures under state law.

  10. National reserves the right to terminate, restrict, suspend or otherwise alter these Rules and/or the Program by notice to Member in accordance with Section A, Paragraph 5, of the Rules as set forth above. The Program is void where prohibited or restricted by law.

  11. “Emerald Club,” “Emerald Club Program,” “National Car Rental” and all associated trademarks, logos and service marks, along with the contents, structure, and features of the Program are the exclusive property of National and its various third party partners and nothing contained in the Rules or by your enrollment or participation in the Program should be construed as granting, by implication, estoppel, or otherwise, any license, interest or right in or to any of the foregoing.

C.   Master Rental Agreement General Terms and Conditions

  1. Membership Cards. Your Card is issued to you for your exclusive use and is not transferable. The Card will be confiscated if anyone else presents it.

  2. Vehicles. The Subsidiaries of Enterprise Holdings, Inc., as listed in Section C, Paragraph 23, and the independent Licensees are either the legal or beneficial owner of the Vehicles. Each Vehicle include tires, tools, equipment, accessories, keys and vehicle documents. The Vehicle is in good operating condition and may only be used solely for rental purposes and not for any commercial purpose. You may not transfer title to the Vehicle. Attempted transfer by you or anyone else on your behalf is void. No one may service or repair the Vehicle without National’s prior express approval. Except as required by law, National MAKES NO EXPRESS OR IMPLIED WARRANTY AS TO ANY MATTER WHATSOEVER INCLUDING, WITHOUT LIMITATION TO, THE CONDITION OF THE VEHICLE, ITS MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE. NATIONAL IS NOT LIABLE FOR ANY INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR RENTAL OF THE VEHICLE .

  3. Who May Drive the Vehicle - Authorized Driver
    a) You represent that you are a validly licensed driver for the type of Vehicle being rented, at least 21 years of age (an Underage Primary Driver Fee will apply for drivers under age 25). National may verify that your license is valid issued and in good standing.
    b) Unless applicable law requires otherwise, the Vehicle may only be driven by you or an Additional Authorized Driver. An "Additional Authorized Driver" is an individual who (i) is a capable and validly licensed driver for the type of Vehicle being rented, (ii) is at least 21 years of age (a young renter fee may apply for drivers under age 25), (iii) has your prior permission to drive the Vehicle, and (iv) is either a member of your immediate family who permanently resides with you, or a fellow employee who drives the Vehicle for business purposes. You will not allow use of the rental vehicle by any driver in violation of the requirements set forth above. Your immediate family members includes your parent, child, spouse or a domestic partner. In addition to the above, Additional Authorized Drivers who otherwise meet National’s qualifications can be added at the time of rental. The Additional Authorized Drivers and you are referred to collectively in the Agreement as Authorized Driver(s).

  4. Vehicle Returns
    a) You shall return the Vehicle to National in the same condition in which you received it, ordinary wear and tear excluded. You shall return the Vehicle to the location where you rented it, either on the due date and the time specified at the time of reservation or upon National's demand. You understand that there will be a rate change or additional charge if you return the Vehicle to a different location or at a different time or due date.

    b) If you request a Vehicle rental for a period in excess of thirty (30) consecutive days, such rental shall be governed by the following terms and conditions. Such long-term rental shall be deemed to be consecutive Vehicle rentals for individual terms of no more than thirty (30) days each (“Rental Period”), but consecutively lasting for a period of time equal to the long-term reservation period reserved by you (“Reservation Period”). The Vehicle rental during each Rental Period is a separate rental distinct from any rental during any other Rental Period rental during the Reservation Period. National will designate a separate rental number for each Vehicle rental during each Rental Period. Each Vehicle rental during the Reservation Period will be charged the same time and mileage rate as set forth in the reservation for the initial Rental Period; however, you acknowledge that taxes, fees, and other charges contained in the reservation for initial Rental Period may be subject to change during subsequent Rental Periods. You acknowledge that you may alter the terms of any current or future Rental Period at any time by coming into any National location and signing a revised rental agreement, which revised agreement will govern each remaining Rental Period. You further acknowledge that you may terminate the balance of the Reservation Period at any time, without penalty, effective at the end of the current Rental Period by returning the Vehicle to the National location where it was picked up. Terminating the remaining Reservation Period effective within a Rental Period may lead to early termination charges as specified in the reservation for such rental, but only with respect to the remainder of the then-current Rental Period. You will be charged for each Rental Period as it commences. You must (A) notify National at the end of each Rental Period of the Vehicle's then-current mileage, and (B) must exchange the Vehicle upon National’s request if maintenance is required.

  5. Reservations. You shall make rental reservations prior to pick up. When making rental reservations, you shall inform National of your Program membership number.

  6. Rates. At the time you make a reservation, we will provide the rate including the cost of all optional products. If you are an eligible renter under a commercial account agreement with National and you present National with that account's name ("Account") and contract I.D. number when making a reservation, you will be charged at the Account's commercial rate. If you are ineligible to rent under a commercial account agreement, you will be charged at the lower of the Program rate or an available promotional rate. Early return of a weekly rental, or early or late return of a weekend rental, may convert your rental rate to a higher daily charge, in addition to early return or late return charges. Extra days may be charged at a higher daily rate .

  7. Entering Master Rental Agreement Transaction. You must present your valid driver's license at the time of rental. A valid credit card issued in your name must be presented upon its initial use at time of rental or if requested by the rental agent .

  8. Vehicle Repossession. National or its authorized agent may repossess the Vehicle without notice at your expense if the Vehicle is found illegally parked, apparently abandoned, used in violation of law or the Agreement, or used for another Prohibited Use (defined in Paragraph 12). Renter and Authorized Drivers hereby waive all claims for damages connected with such repossession, including loss or damage to contents, and shall pay all expenses incurred by National in returning Vehicle to the original rental office .

  9. Responsibility for loss of or damage to the Vehicle. You accept responsibility for damage to, loss or theft of, the Vehicle or any part thereof plus the replacement cost of any applicable Optional Accessories lost, stolen or damaged regardless of fault or negligence of you or any other person or act of God as permitted by law. You shall pay National the amount necessary to repair Vehicle. You shall not have Vehicle repaired without permission from National. If Vehicle is stolen and not recovered or National determines Vehicle is salvage, you shall pay National the fair market value less any sale proceeds. For purposes of this Agreement, fair market value shall be the retail value of Vehicle immediately preceding the loss. In the case of Rentals from a Licensee, unless prohibited or limited by state law, damages for which you are also responsible include but are not limited to: loss of use regardless of fleet utilization, claim administrative fees, diminishment of value, towing, storage or impound fees, and other costs (including attorney’s fees) incurred by National to recover Vehicle and establish damages. In the case of all other Rentals, unless prohibited or limited by state law, damages for which you are also responsible include but are not limited to: loss of use regardless of fleet utilization (total labor hours from the repair estimate divided by 4 (for IA and NV divided by 8), multiplied by the daily rate plus any Car Class Change), claim administrative fees ($50 if the repair estimate is less than $500, $100 if between $500 and $1499, and $150 if greater than $1500), diminishment of value (10% of the repair estimate if the damages are greater than $499), towing, storage or impound fees, and other costs incurred by National to recover Vehicle and to establish damages. If Vehicle is returned during non-business hours or to any place other than the location set forth herein, any damage to, loss or theft of, Vehicle occurring prior to an employee of National checking in Vehicle is your responsibility. See paragraph 10 below for information on Optional LDW.

  1. Optional Loss Damage Waiver ("LDW") and Optional Insurance Coverages. The information provided in this Section contains important information about optional insurance coverage and LDW that you may have purchased in connection with this Agreement. The benefits are only as described in this Agreement and in any underlying insurance policy covering the rental. Written information concerning other optional insurance coverages will be provided upon request at the time of purchase. Your proof of coverage under any optional insurance coverage or optional LDW is this Agreement.
    THE ELECTION OF ANY OPTIONAL INSURANCE PRODUCT OR LDW IS NOT NECESSARY TO RENT A VEHICLE. SUBJECT TO LAW, ENROLLMENT IN AN OPTIONAL INSURANCE COVERAGE OR OPTIONAL LOSS DAMAGE WAIVER PRODUCT IS VOID AND OF NO FORCE OR EFFECT IF AT THE TIME OF THE ACCIDENT OR LOSS YOU OR ANY AUTHORIZED DRIVER WAS ENGAGED IN ANY OF THE "PROHIBITED USES AND VIOLATIONS" DESCRIBED IN THE AGREEMENT, BELOW, EXCEPT AS LIMITED BY CONTROLLING STATE LAW. Upon the expiration of the rental period, unless an extension is properly obtained as described in this Agreement, all insurance coverages and optional LDW purchased under this Agreement are void.

    1. Loss Damage Waiver Option (LDW)

      Your own auto or umbrella policies or credit card coverage may provide rental car damage or loss coverage; however, National cannot interpret or advise you with respect to what they may cover. THE ELECTION OF OPTIONAL LDW OFFERED BY NATIONAL MIGHT DUPLICATE, VOID OR CAUSE YOUR OWN POLICIES OR CREDIT CARD COVERAGE TO BECOME EXCESS COVERAGE.

      You may purchase optional LDW for an additional fee. LDW is not available at all locations. If you purchase LDW, National agrees, subject to the actions that invalidate LDW listed in Paragraph 12 herein (Prohibited Uses) or defined by state law, to contractually waive your responsibility for damage to, loss or theft of, the Vehicle or any part or accessory (excluding keys, key fobs, remote entry devices and any other equipment, except where required by law) and related costs regardless of fault or negligence. LDW does not apply in Mexico. LDW is not insurance. When deciding whether or not to purchase LDW, you may wish to check with your insurance representative or credit card company to determine whether, in the event of damage to or loss of Vehicle, you have coverage or protection for such damage or loss and the amount of your deductible or out-of-pocket risk.

      Your decision to accept or reject LDW may be determined by the Account's National contract when you rent under the Program. You may accept LDW by filling in or clicking on the appropriate bubble on your Profile. Your decision to accept or decline LDW on your Profile will apply to all Rentals you make under the Program except (A) you can choose a different option for any individual Rental by renting at the National self-service kiosk or counter at the rental location; and (B) you can change your decision to accept or decline LDW for future transactions by changing your Profile at www.nationalcar.com or by sending National a Master Rental Agreement Profile Change Form indicating your change in writing. You can obtain a Master Rental Agreement Profile Change Form by contacting National at 1-800-962-7070, Monday through Friday, 9:00 am - 6 p.m. EST, or at any National rental locations. On any Rentals where you choose LDW, you agree to pay the per day LDW charge in effect at the time of the Rental for each full or partial day. The LDW charge may change from time to time. You can obtain National' s current LDW charge at the time you reserve a Vehicle.

    2. Supplemental Liability Insurance (SLI) Where Available

      Your own auto or umbrella policies or credit card coverage may provide liability coverage while operating a rental vehicle; however, National cannot interpret or advise you with respect to what they may cover. THE ELECTION OF ANY OPTIONAL INSURANCE COVERAGE OFFERED BY NATIONAL MIGHT DUPLICATE, VOID OR CAUSE YOUR OWN POLICIES OR CREDIT CARD COVERAGE TO BECOME EXCESS COVERAGE.

      You acknowledge you have read and understand National's materials describing SLI and your option to purchase this product. If SLI is selected and paid for, National provides you or any additional Authorized Driver with third party liability protection in an amount equal to the minimum financial responsibility limits applicable to the Vehicle (the Primary Protection). SLI also provides additional third party liability protection, through an excess liability policy, with limits of the difference between the Primary Protection and a combined single limit of $1 million per accident for bodily injury, death and/or property damage to others arising out of the use or operation of the National Rental Vehicle by you or an additional Authorized Driver, subject to the terms and conditions of the policy. SLI provides UM/UIM coverage for bodily injury and property damage in an amount equal to the minimum financial responsibility limits applicable to the Vehicle, and through an excess policy, the difference between the statutory minimum underlying limits and $100,000 per accident (For Rentals commencing in New York, $100,000 per person/$300,000 per accident, for rentals commencing in Hawaii, UM/UIM limits are $1,000,000 combined single limit) or state mandated UM/UIM limits, whichever is greater. NATIONAL AND YOU REJECT ANY ADDITIONAL UM/UIM COVERAGE TO THE EXTENT PERMITTED BY LAW. SLI, including UM/UIM benefits is provided only when you or any Authorized Driver is driving the Vehicle. No claim for UM/UIM may be made due to the negligence of the driver of the Vehicle. SLI coverage is in effect only while another Authorized Driver or you are driving the Vehicle within the United States, Puerto Rico, and Canada, and does not apply for an accident that occurs while the Vehicle is obtained or used in violation of the Agreement. COVERAGE DOES NOT APPLY IN MEXICO. ADDITIONAL POLICY EXCLUSIONS INCLUDE: (A) BODILY INJURY OR DEATH TO YOU OR TO THE BLOOD RELATIVES OR FAMILY OF ANY AUTHORIZED DRIVER, IF SUCH RELATIVES OR FAMILY RESIDE IN THE SAME HOUSEHOLD WITH YOU OR WITH AN AUTHORIZED DRIVER; (B) PROPERTY DAMAGE TO THE RENTAL VEHICLE; (C) FINES, PENALTIES, EXEMPLARY OR PUNITIVE DAMAGES; (D) BODILY INJURY, DEATH OR PROPERTY DAMAGE EXPECTED OR INTENDED FROM THE STANDPOINT OF THE INSURED; AND (E) ANY OBLIGATION FOR WHICH THE INSURED OR THE INSURED’S INSURER MAY BE HELD LIABLE UNDER ANY WORKER’S COMPENSATION, DISABILITY BENEFITS OR UNEMPLOYMENT COMPENSATION LAW OR ANY SIMILAR LAW. Note: Any UM/UIM benefits paid are included in the $1 million combined single limit SLI coverage and in no way increase the combined single limit amount referenced above. This insurance coverage is underwritten by Ace American Insurance Company. Underwriting insurer subject to change without notice.       You may accept SLI by filling in or clicking on the appropriate bubble on your Profile. Your decision to accept or reject SLI may be determined by the Account's National contract when you rent under the Program. Your decision to accept or decline SLI on your Profile will apply to all Rentals you make under the Program except (A) you can choose a different option for any individual Rental by renting at National's counter at the rental location; and (B) you can change your decision to accept or decline SLI by changing your Profile at www.nationalcar.com or by sending National a Master Rental Agreement Profile Change Form indicating your change in writing. You can obtain a Master Rental Agreement Profile Change Form by contacting National at 1-800-962-7070, Monday through Friday, 9:00 am - 6 p.m. EST, or at any of National's rental locations. On any Rental where you accept SLI, you agree to pay the per day SLI charge in effect at the time of the Rental for each full or partial day. The SLI charge may change from time to time. You can obtain your current SLI charge at the time you reserve a Vehicle. Availability, cost, coverage and the provider of this protection may vary by location. For additional information, inquire at the time of each Rental.

    3. Personal Accident Insurance / Personal Effects Coverage (PAI/PEC): U.S. and Puerto Rico

      (Where available): If selected and paid for, PAI provides Renter and Renter’s passengers with Accidental Death, Accident Medical Expenses and Ambulance Expense benefits. PEC insures the personal effects of Renter, or any member of Renter’s imemdiate family who permanently resides in Renter’s household and who is traveling with Renter, against risks of loss or damage while in transit or in a building, (other than your personal residence) or locked in the Vehicle. PAI & PEC are available for an additional charge as stipulated on page 1 of the Rental Agreement. “Renter” is the person who signs the Rental Agreement as Renter.

Anyone other than Renter occupying or operating Vehicle shall be considered a "Passenger" for the purposes of PAI benefits.

      PEC Benefits

      $600 per person; $1,800 maximum coverage for all covered individuals during the Rental Period.
      PEC benefits apply to personal effects belonging to Renter, or any member of renter's immediate family who permanently resides in Renter's household and who is traveling with Renter, against risks of loss or damage while in transit or in a building,(other than your personal residence) or locked in the Vehicle.

      PAI & PEC Exclusions

      PAI shall not cover any death or injury caused wholly or partly, directly or indirectly by suicide, attempted suicide, or self inflicted injury; aircraft travel, except as a passenger in a licensed aircraft on a regularly scheduled flight; committing or attempting to commit a criminal offense; an accident which occurs while under the influence of alcohol or narcotics, unless prescribed by a physician; an accident which occurs while participating in a prearranged or organized race or testing of a vehicle; war or any act of war; or engagement in an illegal occupation; nor shall this insurance be in effect if Renter converts Vehicle or during any period Renter is in violation of the Rental Agreement. Renter shall be deemed to have converted Vehicle whenever Vehicle is not returned to the National by the return date or by the extended return date.
      PEC shall not cover automobiles, automobile equipment, motorcycles, watercraft, motors, or other conveyances or their appurtenances, furniture, currency, coins, deeds, bullion, stamps, tickets, securities, documents, contact lenses, artificial teeth and limbs, perishables and animals. Loss or damage to property while actually being worked upon, or while in the care, custody or control of any common carrier are also not covered. THE POLICY DOES NOT COVER LOSS BY MYSTERIOUS DISAPPEARANCE. ALL LOSSES BY THEFT MUST BE REPORTED TO THE APPROPRIATE LAW ENFORCEMENT AUTHORITIES OR THEY WILL NOT BE COVERED.

    4. Personal Accident Insurance / Personal Effects Coverage (PAI/PEC): Canada

      PAI/PEC is an optional product that is offered at select National locations in Canada.

      Optional Personal Accident and Personal Effects Insurance

      Purchase of Personal Accident and Personal Effects Insurance (PAI/PEC) is optional and not required to rent a vehicle. This is a summary only and is subject to all provisions, limitations and exceptions of the PAI/PEC policy issues by Aviva Insurance Company. Upon Request, a copy of the policy is available for review. PAI/PEC may provide a duplication of coverage already furnished by a personal accident insurance policy, personal effects insurance policy, comprehensive homeowner's or tenant's policy or some other source. Benefits available under PAI/PEC, however, will be paid in addition to those received from any other source. National's employees, agents or endorsees are not qualified to evaluate the adequacy of the renter's existing coverage.

      PAI/PEC does not provide coverage outside of Canada and the U.S. PAI/PEC is available for an additional charge as stipulated on the rental agreement. "Renter" is the person who signs the Rental Agreement.

      The Personal Accident Insurance Section (PAI) contained in the policy provides Renter and Renter's passengers with Accidental Death, Medical Expenses and Dental benefits.

PEC benefits apply to personal effects belonging to Renter and Rental Passengers who are traveling with Renter, against risks of loss or damage while in transit or in a building during a journey using Vehicle.

      PEC Exclusions

      For all exclusions, see the PAI/PEC policy issued under Aviva Insurance Company.     5. NATIONAL PEACE OF MIND PACKAGE (CANADA)

      The following applies to the purchase of this optional product in Canada.

      The Peace of Mind Package ("POM") is a combination of the LDW and the Personal Accident/Personal Effects Coverages described above. Purchase of POM is optional and not required to rent a vehicle. When you purchase the POM, you are provided the LDW (waive deductible in most instances), plus the coverages already identified as Personal Accident/Personal Effects. All limitations, exclusions and aggregate apply as outlined above.

      The foregoing is merely a summary of SLI, PAI, PEC and POM and is not intended to act as a substitute for the actual insurance policies, which insurance policies will govern in all cases. SLI, PAI, PEC and POM are subject to all provisions, limitations, and exceptions of the applicable policy applicable at the time of purchase. Upon request, a copy of the policy applicable with its complete terms and conditions is available for your inspection. National reserves the right to change insurance carriers or otherwise modify the insurance programs as it deems necessary.

  2. Liability Insurance or Qualified Self-Insurance

    Unless contrary to law or otherwise provided by the Agreement, if no other valid and collectable insurance sufficient to satisfy minimum financial responsibility requirements or compulsory insurance laws, whether primary, excess or contingent, is available to the Authorized Driver(s), National shall provide protection where required against liability for bodily injury, death or property damage to others up to the minimum financial responsibility limits required by the jurisdiction in which the Vehicle is rented. National will provide primary liability protection, regardless of the availability of other insurance if:

    • You accept optional SLI in your Profile or Supplemental Liability Insurance (SLI) at the beginning of the Rental (where available); or

    • Primary liability protection is provided pursuant to a separate Account agreement; or

    • If applicable law requires National to provide primary liability protection.

    Except as to the extent SLI or SLI applies or as otherwise provided herein, the protection provided under the Agreement is in excess of all other insurance available to the Authorized Driver(s). If the liability protection provided under this Agreement and other insurance available to the Authorized Driver(s) apply to a loss on the same basis, National will pay only National's share of such loss. National's share is the proportion that the limit of protection provided under the Agreement bears to the total limit of all insurance applicable to such loss. IF LIABILITY PROTECTION IS PROVIDED UNDER THE AGREEMENT, WHETHER AS PART OF THE RENTAL RATE OR THROUGH THE PURCHASE OF SLI OR SLI, THEN IT APPLIES ONLY TO CLAIMS OF THIRD PARTY BODILY INJURY, DEATH OR PROPERTY DAMAGE, OTHER THAN TO THE VEHICLE, ARISING FROM THE USE OF THE VEHICLE AS PERMITTED BY THIS AGREEMENT. ANY SUCH PROTECTION EXCLUDES ANY CLAIM MADE BY YOU, ANY ADDITIONAL AUTHORIZED DRIVER, ANY MEMBER OF MY IMMEDIATE FAMILY WHO PERMANENTLY LIVES WITH ME, OR A FELLOW EMPLOYEE WHO DRIVES THE VEHICLE FOR BUSINESS PURPOSES. Except as may be provided pursuant to SLI, National and you reject "Uninsured Motorist" and "Underinsured Motorist" protection and minimum "No-Fault" and any supplementary No-Fault protection except to the extent applicable law (A) requires National to provide those protections, or (B) prohibits the rejection of those protections. If required and not rejectable, the limits for this protection are the minimum required by the jurisdiction in which the Vehicle is rented. These protections, if required by law, are provided on the same basis as the liability protection provided under the Agreement. In the event of an accident, all Authorized Driver(s) will (A) provide National with the name of their insurance companies, (B) cooperate fully with National in presenting claims and in any other aspects of the claims process, and (C) report the loss to the Authorized Driver(s)' insurance company. If a claim is made or lawsuit filed and no other source of defense is available to the Authorized Driver(s), National may defend the claim or lawsuit, at National' s sole discretion, even if the claim or lawsuit proves to be groundless, false or fraudulent. In defending a claim or lawsuit, National may, at National' s discretion, make any settlements National considers advisable. National has no duty to further defend any Authorized Driver(s), if assumed, upon exhaustion of the limits required by the automobile financial responsibility or compulsory insurance laws of the jurisdiction in which the Vehicle is rented. All Authorized Driver(s) agree to defend, indemnify and hold National harmless from and against all loss, liability and expenses as a result of bodily injury, death or property damage caused by, or arising out of the use or operation of the Vehicle, except for amounts paid by National pursuant to this Paragraph. All Authorized Driver(s) agree to comply with and be bound by all terms, conditions, limitations and restrictions of any protection provided by National. All Authorized Driver(s) shall comply with the procedures on accident and claims reporting set forth in Paragraph 18. Evidence of this insurance or qualified self-insurance is available for inspection at National. You understand that the protection does not apply to:

    • Any obligation assumed by Authorized Driver(s) under any contract of whatever nature.

    • Any fines, penalties, punitive damages or exemplary damages for which Authorized Driver(s) may become legally obligated to pay.

    • Injury to or destruction of personal property owned by or in the possession, custody or control of any Authorized Driver(s) or passenger.

    • Any liability of a driver who is not an Authorized Driver(s) and any liability for an accident that occurs while the Vehicle is obtained or used in violation of the Agreement. If the liability protection is extended by operation of law to anyone not permitted by the Agreement to drive the Vehicle, the limits of protection shall be those required to satisfy the minimum financial responsibility or compulsory insurance laws of the jurisdiction in which the Vehicle is rented. This liability protection will apply on the same basis as described previously in this Paragraph.

    • Any act or omission in Mexico.

    National maintains third party liability insurance, which is equal to the mandatory provincial liability coverage in all-Canadian provinces and territories. Since this coverage is considered statutory, the limits could change depending upon the legal requirements placed on National to operate car rental facilities within Canada.

  3. Prohibited Uses of the Vehicle
    No Vehicle may be used by or for any of the following uses (each, a "Prohibited Use"), subject to applicable law:

    • By a driver who is not an Authorized Driver(s).

    • By any driver under the influence of intoxicants, drugs, or any other substance known to impair driving ability.

    • For any illegal purpose.

    • By anyone who gives you a false name, address, age or other false or misleading information.

    • In any abusive or reckless manner or if convicted of careless driving.

    • To carry persons or property for hire.

    • To tow or push anything.

    • In any race, contest or training activity.

    • On unpaved roads.

    • If the vehicle is stolen and the member does not return the original ignition key, file a police report and cooperate with National.

    • For any use in Mexico without the prior written permission of the renting location. All protection is void in Mexico. National' s written permission must be obtained and special insurance must be maintained before entering Mexico.

    IF THE VEHICLE IS OBTAINED OR USED BY OR FOR ANY PROHIBITED USE OR IN VIOLATION OF THE AGREEMENT, THEN, EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAW (A) ANY LIMITATION OF YOUR RESPONSIBILITY UNDER THE AGREEMENT IS VOID AND YOU ARE FULLY RESPONSIBLE FOR ALL RESULTING DAMAGES, INCLUDING THE COST TO REPAIR THE VEHICLE UP TO THE VEHICLE FAIR MARKET VALUE, LOSS OF USE, ADMINISTRATIVE CHARGES, DIMINISHMENT OF VALUE, AND ATTORNEY' S FEES, AND (B) WHERE PERMITTED BY LAW, LDW AND THE LIABILITY PROTECTION, AND SLI INSURANCE ARE VOID.

  4. Payment

    a) Minimum Charges - The minimum rental charge is for one day (24 hours) beginning at the time of Rental, plus mileage (if applicable).

    b) You agree to pay upon demand:

    1. All rates, charges, surcharges, taxes and airport fees, including charges for miscellaneous service and equipment, then in effect, which apply to the Vehicle you drive under the Program for the term of the Rental transaction. You can obtain the applicable rates, charges, surcharges, fees and taxes at the time you make a reservation; they will also appear on the receipt you will receive at the time of Rental. A more expansive description of certain charges that may apply to your Rentals is set forth below.

    2. Vehicle Damages or Loss - See Paragraph 9.

    3. Collection and vehicle recovery expenses, as described in Paragraph 4 and 8.

    4. Fines and Penalties - All fines, penalties, and related expenses, as described in Paragraph 20.

    5. Charges for all optional products selected, including, without limitation, Collision Damage Waiver (LDW), Supplemental Liability Insurance (SLI), Personal Accident Insurance/Personal Effects Coverage (PAI/PEC), Roadside Plus (RSP), Toll Pass devices, global positioning devices, infant/child seats, and Fuel Service Option (FSO), if elected, as described herein.

    6. Refueling Service Charges - You will be required to pay a refueling service charge if you do not return the Vehicle with the same amount of fuel as when you received it as noted on the fuel gauge at the time of rental as stated in Paragraph 14.

    7. Sales Tax and Other Governmentally Mandated Charges; Mandatory Airport Related Charges.

    8. States, counties, cities and other governmental authorities may impose sales taxes, gross receipts taxes, fees and other mandatory charges, such as arena or stadium fees, on customers of car rental companies or car rental transactions. For Rentals commencing in California, a percentage charge applies called the tourism commission assessment recovery by which National recovers the tourism assessment applicable to this rental as permitted by Section 13995.65 of the Government Code. These charges appear in the charges section of the applicable rental receipt. At certain airport locations where National is an on-airport concessionaire, National is required to collect other mandatory charges from its customers and to remit them to the airport; these are sometimes referred to as Customer Facility Charges, Airport Facility Charges, or Transportation Facility Charges. Applicable charges are set forth at the time of reservation and on the applicable rental receipt.

    9. Airport Surcharges. In the event Member did not arrive at certain airports by plane within a specified period prior to the commencement of a rental transaction, certain airport surcharges are not applicable. Certain other surcharges may not be applicable to vehicles rented as temporary replacements for vehicles unavailable due to mechanical breakdown, repair, service, damage or loss. These surcharges will not be assessed if (A) Member advises a rental agent at the counter at the time of the rental transaction that either (i) the Member did not arrive at the airport by plane prior to the commencement of the rental transaction or (ii) the vehicle will be utilized as a replacement vehicle, and (B) the rental agent determines that the surcharge is not applicable to such Member as a result of same. In the event Member bypasses the counter at the time of the rental transaction without advising the rental agent of the foregoing facts, Member acknowledges and agrees to incur certain surcharges that may not otherwise have been applicable.


    10. Other Non-Governmentally Mandated Charges; Non-Mandatory Airport, Hotel and Other Charges.

    11. Concession Fee Recovery. The Concession Fee Recovery is National's charge to recover the estimated fees paid by National to the owner or operator of the location being serviced by National for the related rental or to the owner or operator of the location of the branch from which You rent the vehicle. At some locations, National has elected to impose "recovery fees" to recover or recoup all or a portion of its expenses related to a type of overhead. At certain locations where National is a concessionaire, National has elected to impose a charge, often referred to as a Concession Fee Recoupment or Concession Fee Recovery, to recover all or a portion of the concession fees or fee on revenue which it is obligated to pay to the owner or operator of the location being serviced or location from which You rent the vehicle. The fee, which varies by location, will appear separately in the charges section of this Agreement as Concession Fee Recovery, Concession Fee Recoupment, Airport Fee, or the like. Other recovery fees that National elects to impose at some locations include, without limitation: a vehicle licensing and registration recovery fee, often called Vehicle License Recovery Fee or "VLRF", which is the per rental day recovery of National' s average annual cost to tag, title, pay taxes on, inspect, and/or register its fleet registered in the applicable jurisdiction; certain tax recoveries not mandated to be charged to the customer by a governmental entity; a Waste Tire and Battery Recovery Fee, which is the recovery of the waste tire and lead-acid battery fee which National must remit in Florida; and a Bussing Cost Recovery charge, which is the per Rental or per rental day recovery of National' s annual cost to provide bussing operations at certain locations. A Frequent Traveler Service Charge will apply for qualifying Rentals in the US, Canada and Puerto Rico when you choose to receive Frequent Traveler miles or credits as part of your Rental. The Frequent Traveler Service Charge is collected by National in order to recover all or a portion of the administrative and program costs associated with participation in frequent flyer programs and may be in addition to charges imposed by your airline' s own Frequent Traveler program. A list of Frequent Traveler Service Charges is available at www.nationalcar.com The specific recoveries that apply to your Rental are set forth at the time of reservation and on the applicable Rental receipt.

      For Alabama rentals, a Surcharge (“Surcharge”) which represents National’s charge to recover the estimated average daily cost per vehicle (not calculated based on the costs imposed upon a particular vehicle) of the charges and taxes imposed by governmental authorities upon National or its affiliates in connection with titling, registering, inspecting, licensing and plating of all vehicles in its/their rental fleet which are registered in Alabama; and a Privilege and License Tax Recovery (PRIV/LIC TAX REC) which is National’s charge to recover the privilege or license tax imposed upon Owner by the State of Alabama and any local taxing authorities. This charge is calculated as a percentage of gross rental proceeds.

    12. The Greenhouse Gas Emission Offset. This is an optional environmental service, chosen at the time of reservation that affords you the opportunity to offset the greenhouse gases emitted by the Vehicle when it burns fossil fuel and releases carbon dioxide (CO2) into the atmosphere. This per-Rental charge represents the estimated amount (as calculated by TerraPass, Inc., a CO2 offset firm) necessary to offset the CO2 emissions produced by the average rental transaction and is not based upon your specific Vehicle or miles driven. Funds collected from this charge are remitted to TerraPass, Inc. See www.terrapass.com for more information.

    13. National will accept any credit cards with available credit listed on your Profile as payment for all charges under the Agreement. You authorize National to reserve credit on your credit card listed on your Profile in an amount equal to all estimated charges. National may bill your credit card listed on your Profile at the time of reservation or upon delivery of the Vehicle. National will bill the credit cards listed on your Profile according to the order of your own selected billing priority against the first card that has available credit.

    14. If you have directed National and National has agreed to bill charges to someone else who fails to make payment promptly when due, you will promptly pay National upon demand. You are individually responsible for payment for all charges you incur under Rentals you make under the Program. If you direct charges to be billed to another person, you represent that you are authorized to give National such direction.

    15. YOU UNDERSTAND THAT ALL CHARGES ARE SUBJECT TO FINAL AUDIT. You authorize any credits or additional charges to be made and paid by the method designated on your Profile.

  • Refueling Services. You may choose one of the following refueling options:

    a) (Prepaid Fuel) The prepaid fuel option means prepaying for a full tank of fuel at the rental location. The price is based on fuel tank capacity of the vehicle rented multiplied by the per gallon charge of the renting location. Additional applicable taxes and surcharges may apply to the prepaid fuel option. This charge may change at the time of rental due to current fuel prices. No refund or credit will be given for unused fuel. If you do not want the prepaid fuel option, you can choose to return the tank full or pay for fuel used and not replaced when you return to the facility. This option must be chosen at the beginning of Rental and is not available at all locations.

    b) (Return Full or Pay) If you do not elect the Fuel Service Option, you may return the Vehicle with the same amount of fuel as when you received it. If you do not return the vehicle with the same amount of fuel as when you received it as noted on the fuel gauge at the time of rental, the Fuel Charge will be the per gallon rate not to exceed 150% of the local market price of self-service gasoline multiplied by National' s estimate of the number of gallons required to return the tank to the level as when received. This estimate is arrived at by using the manufacturer specified tank capacity for the Vehicle and then determining the capacity of the portion of the tank to return the tank to the level of when received. In any event, the Fuel Charge shall not exceed the price permitted under state law.

  • Roadside Plus (RSP) (Where available)

    If selected and paid for at the time of rental, National offers a Roadside Plus, which provides 24/7 roadside assistance without additional charge. RSP includes replacement of lost keys (including remote entry devices), towing, spare tire installation, lockout service, jumpstarts, and fuel delivery service for up to 3 gallons (or equivalent litres) of fuel. RSP services are only available in the 50 United States and Canada. RSP IS VOID AND OF NO FORCE OR EFFECT IF AT THE TIME OF THE INCIDENT YOU (OR ANY AUTHORIZED DRIVER) WERE ENGAGED IN ANY OF THE "PROHIBITED USES AND VIOLATIONS" DESCRIBED IN THIS AGREEMENT. For roadside assistance call 1-800-803-4444.

  • Toll Road Options: depending on the rental location and / or the toll road used, the following may apply.

    a) Optional Tollpass Transponder Service (where available): If selected and paid for at the time of rental, National provides for the daily rental of a toll collection transponder at a daily fee which will be quoted to you at the time of reservation. This daily fee will be collected by National along with your other rental charges. No credit is provided for days of no usage. In addition, a third party firm under contract with National will separately charge your credit or debit card for the cost of all toll and related charges you incur during your Toll Pass Transponder rental. Tollpass Transponder Service has a limited service area; attempting to use the service outside the service area may subject you to fines and penalties. See Paragraph 20.

    b)  Optional Toll Transponder-Flat Rate Service (where available): If selected and paid for at the time of rental, National provides for the daily rental of a toll collection transponder. Renter pays a daily charge for the Toll Transponder-Flat Rate Service and National is responsible for the cost of all tolls incurred during the Rental Period within the Toll Transponder-Flat Rate Service area. No credit is provided for days of no usage. Toll Transponder-Flat Rate Service has a limited service area; attempting to use the service outside the service area may subject you to fines and penalties. See Paragraph 20.

    c)  Tollpass Convenience Charge (TCC) (where available): A Tollpass Convenience Charge (TCC) (where available) of up to $5.00 per day of Rental Period for each day Vehicle is operated on a TCC Covered Road and Vehicle operator does not pay an applicable toll. Total TCC charges will not exceed $15.00 per Rental Period. In addition to the TCC, National or a third party may separately charge Renter's credit or debit card for the cost of all tolls not paid by Vehicle operator incurred during the Rental Period. A current listing of TCC Covered Roads is available upon request, at www.htallc.com/national or (877) 860-1258. Operation of Vehicle on a roadway or bridge not covered by TCC may subject the Renter to fines and penalties see Paragraph 20.

    YOU EXPRESSLY AUTHORIZE NATIONAL TO TRANSFER YOUR NAME, ADDRESS, CREDIT CARD INFORMATION AND ALL OTHER DATA NECESSARY TO ENABLE THE COLLECTION OF ALL TOLLS AND ASSOCIATED CHARGES INCURRED DURING THE APPLICABLE RENTAL.

  • Optional Greenhouse Gas Emission Offset (Where available).   • Accident, Theft and Claims Reporting. You and the other Authorized Driver(s) must immediately report any accident or theft involving the Vehicle to the law enforcement authority in the jurisdiction where the accident or theft occurred and to National at National' s location where the Vehicle was rented. In connection with such accident or theft, you and the other Authorized Driver(s) must (A) inform National of the jurisdiction where the report was made to law enforcement authorities, and (B) deliver to National at the location where the Vehicle was rented every summons, complaint, or paper received in any way relating to such accident or theft. You and the other Authorized Driver(s) will not aid or encourage the filing of any claim against National as a result of any accident or theft and will cooperate fully with National and National's insurer, if any, in investigating and defending any claim or lawsuit.

  • Responsibility for Personal Property. National is not responsible for loss of or damage to your property or the property of others left at any time in or on any Vehicle or in or on National's premises, even if it is in National's possession and regardless of who is at fault. You will be responsible to National for all claims made by others for such loss or damage.

  • Fines and Penalties. You will promptly pay any parking and traffic fines, unpaid tolls and related fines, towing, storage, and related costs (collectively, "violations") incurred during the rental. You hereby authorize National to supply your name and contact information to relevant governmental agencies and collection firms in connection with any violations. In the event that your name and contact information are so supplied, you authorize National to collect an administrative fee from you in the amount of up to $25.00 per event. If National has to pay any violations on your behalf, you agree to reimburse National for the amount of each violation, together with a $25.00 administrative fee ($20.00 in Hawaii). You will promptly report such violations to National and will indemnify and hold National harmless from all claims and costs arising out of such violations, including expenses in connection with the handling of such matters. You agree that fines, penalties and costs arising from parking or traffic violations may be billed to the credit card(s) issuer(s) listed on your Profile.

  • General Provisions


  • a ) You are responsible for unauthorized repairs. National will not reimburse you for authorized repairs without receipts.

    b ) Authorized Driver(s) are responsible for:

    1. complying with all applicable seat belt and child restraint laws, and

    2. protecting all children by properly using any child passenger restraint system that complies with Motor Vehicle Safety Standards in the jurisdiction where the rental occurs and the Vehicles are driven during such rental. Authorized Driver(s) must supply this child restraint system or rent it from National.

    c) You will never be deemed to be National's agent, servant or employee in any manner or for any purpose whatsoever.

    d) National does not waive any rights under the Agreement or otherwise except in a writing signed by one of National's officers or authorized representatives.

    e) The Authorized Driver(s) authorize National to release to any governmental agency or court, any information relating to any person who uses any Vehicle during any rental.

    f) No vouchers, travel orders or any variations from the Terms will be accepted on Emerald Club Rentals.

    g) The information you provide is and will be true and correct. The options you choose and the information you provide in your Profile apply to all rental transactions you make under the Program. You can change your options and information for future rental transactions under this Program by changing the options and information entered into your Profile at nationalcar.com or by sending National a Master Rental Agreement Profile Change Form, indicating the changed options and information in writing.

    You agree to notify National at once if your Card or any credit card listed in your Profile is (1) lost, stolen or invalidated, or (2) or you suspect that it is being used without your permission, or (3) expires.

    h) You agree that, for each separate Rental hereunder, the substantive laws of the jurisdiction in which the Rental originates shall govern that particular Rental under this Agreement. In the event of a dispute, claim or cause of action under this Agreement outside of an individual Rental, the substantive laws of the State of Missouri shall apply without regard to choice of law or conflict of law principles (whether of the State of Missouri or any other jurisdiction). You agree to pay National's reasonable attorneys' fees and costs in any lawsuit relating to this Agreement in which you do not prevail, including appeals. If you make a claim against National, you agree to provide National with a detailed statement under oath in support of the claim. You must not aid or encourage the filing of any third-party claim or lawsuit against National, and you must cooperate fully with National and National's insurer, if any, in investigating and defending any such claim or lawsuit. You must immediately deliver to National at the renting location (or at such other address specified by National) every summons, complaint, or paper of any kind received by you in any way relating to an accident or theft involving the Vehicle. YOU WAIVE YOUR RIGHT TO A JURY TRIAL IN ANY LAWSUIT RELATING TO THIS AGREEMENT.

    i) Indemnification & Limits on Liability: You shall indemnify, defend, and hold National harmless from all losses, liabilities, damages, injuries, claims, demands, costs, attorneys' fees, and other expenses incurred by National arising from or related to this Agreement, the Vehicle, or its use by any person. This indemnification may be limited to the extent you have purchased one or more optional protection products from National in connection with this rental. NATIONAL SHALL NOT BE LIABLE TO YOU OR TO ANY AUTHORIZED DRIVER FOR ANY INDIRECT, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES (INCLUDING LOST PROFITS) ARISING FROM OR RELATED TO THE VEHICLE, IT'S USE, OR THIS AGREEMENT.

    j) The law of the state of rental may change, limit or prohibit any part of this Agreement (such as LDW, Authorized Drivers, Prohibited Uses and Violations, or damage losses allowed.) If so, that law applies. This Agreement is not an application for insurance

    k) You confirm that the name, and email address you have provided to National in your Profile are correct, and you acknowledge that any correspondence, notices or emails will be sent to you in accordance with Section A, Paragraph 5. Notices to National must be sent to National Car Rental, Attn: Marketing at 600 Corporate Park Drive, St. Louis, MO 63105.

    l) Telematics Notice and Release. Vehicle may be equipped with OnStar or another telematics system. You acknowledge that such systems utilize cellular telephone and/or radio signals to transmit data and communication and, therefore, privacy cannot be guaranteed and is specifically disclaimed by You. You authorize use or disclosure of or access to (i.) call location information concerning You or other user of the service, (ii.) automatic crash notification to any person for use in the operation of an automatic crash notification system, (iii.) use of the vehicle location system and (iv.) operational condition, mileage, diagnostic and performance reporting of Rental Vehicle as permitted by law. You shall inform any and all AAD(s) of the foregoing. You release National and agree to indemnify, defend and hold harmless National, operator of the telematics system, wireless carrier(s) and other suppliers of components or services and their respective employees, officers, directors and agents from any damage (including incidental and/or consequential damages) to persons (including without limitation You or any AAD) or property caused by failure of the telematics system to operate properly or otherwise arising from the use of the telematics system by You, an AAD or National. Third party service providers are not agents, employees, or contractors of National. For limitations concerning warranty, privacy and performance of the telematics system in Rental Vehicle, contact the telematics provider.

    m) The Vehicle may be equipped with an event data recorder. In the event of an accident, this device records data about the Vehicle, typically for a period of 30 seconds or less prior to the accident. Although this device does not collect or store personal information, this data may be retrieved as part of a post-accident investigation and you consent to such retrieval of data by National or its representatives and insurers.

    n) The information you provide to National is stored and used in accordance with National's privacy policy, which is available at www.nationalcar.com and for Canadian rentals at www.nationalcar.ca, which may be amended from time to time and which is incorporated herein by reference. You agree that National may provide your personal data to third parties which conduct services on its behalf (such as consumer satisfaction surveys) and consents to National's representative contacting Renter on a cell phone or other phone number listed on the Rental Agreement or otherwise provided to National. Some National locations in the U.S. and Canada, are owned and operated by independent licensees that are not controlled by us or our Affiliate companies ("Licensees"). National does not control the use of any personally identifiable or payment information collected by its Licensees. Licensees are required to identify themselves (i.e., at their locations and in their agreements, sales materials, business cards, marketing materials, advertisements and other National branded materials) as "An Independent National Car Rental Licensee" or by other similar terms. National is not responsible for the Licensees' information practices. For more information, see Section A, Paragraph 6.

  • Important Disclosures


  • You acknowledge that you have received, read and understood the following IMPORTANT DISLOSURE NOTICES. You waive any right to receive and sign additional protection disclosure notices and any notices at the time of each rental in order to avoid rental paperwork and delays. These disclosure notices are also available online at emeraldclub.com.

    ARIZONA RENTALS: National's liability insurance does not cover injuries to passengers in the rental vehicle. The insurance policies National offers may provide duplication of coverage already provided by your personal automobile insurance policy or by another source of coverage. You are not required to purchase such insurance in order to rent a vehicle.

    AZ Warning: ARIZONA REVISED STATUTE SECTION 13-1806 PROVIDES THE FOLLOWING, "A PERSON COMMITS UNLAWFUL FAILURE TO RETURN RENTED PROPERTY IF, WITHOUT NOTICE TO AND PERMISSION OF THE LESSOR OF THE PROPERTY, THE PERSON KNOWINGLY FAILS WITHOUT GOOD CAUSE TO RETURN THE PROPERTY WITHIN SEVENTY-TWO HOURS AFTER THE TIME PROVIDED FOR IN THE RENTAL AGREEMENT. UNLAWFUL FAILURE TO RETURN RENTED OR LEASED PROPERTY IF THE PROPERTY IS A MOTOR VEHICLE IS A CLASS 5 FELONY." THE MAXIMUM PENALTY FOR THIS OFFENSE IS IMPRISONMENT FOR 2 YEARS AND A FINE OF NOT MORE THAN $150,000 FOR THE FIRST OFFENSE

    EFFECTIVE NOVEMBER 1, 2012: THE OWNER(NATIONAL) DOES NOT EXTEND ANY OF ITS MOTOR VEHICLE FINANCIAL RESPONSIBILITY OR PROVIDE PUBLIC LIABILITY INSURANCE COVERAGE TO THE RENTER, AUTHORIZED DRIVERS OR ANY OTHER DRIVER.

    CALIFORNIA DISCLOSURE NOTICE: You are responsible for all collision damage to the vehicle even if someone else caused it or the cause is unknown. You are responsible for the cost of repair up to the fair market value of the vehicle, administrative fees, towing, storage, and impound fees. Renter is responsible for the first $500 of vandalism that is not a direct result of the actual theft of Vehicle. Renter will be responsible for theft of Vehicle or damages resulting from the theft of Vehicle if Renter or Authorized Driver(s) fails to exercise ordinary care of Vehicle during the Rental Period. Your own insurance, or the issuer of the credit card you use to pay for rentals under the agreement may cover all or part of your financial responsibility for the vehicle. You should check with your insurance company or credit card issuer to find out about your coverage and the amount of the deductible, if any, for which you may be liable. Further, if you use a credit card that provides coverage for your potential liability, you should check with the issuer to determine if you must first exhaust the coverage limits of your own insurance before the credit card coverage applies. We will not hold you responsible if you purchase a damage waiver, but a damage waiver will not protect you from damage arising from a prohibited use (described below). The daily cost of an optional damage waiver will vary based on the time and location of rental but will generally range from $9.00 to $26.99 per day, depending on the vehicle rented.

    Damage waiver does not apply if :

      (1) Damage or loss results from an authorized driver's (A) intentional, willful, wanton, or reckless conduct, (B) operation of the vehicle under the influence of drugs or alcohol in violation of Section 23152 of the Vehicle Code, (C) towing or pushing anything, or (D) operation of the vehicle on an unpaved road if the damage or loss is a direct result of the road or driving conditions.
      (2) Damage or loss occurs while the vehicle is (A) used for commercial hire, (B) used in connection with conduct that could be properly charged as a felony, C) involved in a speed test or contest or in driver training activity, (D) operated by a person other than an authorized driver, or (E) operated outside the United States.
      (3) An authorized driver who has (A) provided fraudulent information to the rental company, or (B) provided false information and the rental company would not have rented the vehicle if it had instead received true information.

    CALIFORNIA LAW REQUIRES ALL CHILDREN UNDER 8 YEARS OF AGE TO BE TRANSPORTED IN THE REAR SEAT OF THE VEHICLE IN A CHILD RESTRAINT SYSTEM. THIS AGENCY IS REQUIRED TO PROVIDE FOR RENTAL OF A CHILD RESTRAINT SYSTEM IF YOU DO NOT HAVE A CHILD RESTRAINT SYSTEM YOURSELF.

    COLORADO NOTICE: This contract offers, for an additional charge, a collision damage waiver to cover your responsibility for damage to the vehicle. You are advised not to sign this waiver if you have rental vehicle collision coverage provided by certain gold or platinum credit cards or collision insurance on your own vehicle. Before deciding whether to purchase the collision damage waiver, you may wish to determine whether your own vehicle insurance affords you coverage for damage to the rental vehicle and the amount of the deductible under your own insurance coverage. The purchase of this collision damage waiver is not mandatory and may be waived.

    CONNECTICUT DISCLOSURE NOTICE: Your personal automobile insurance policy may cover collision damage, fire and theft damage and personal injury incurred while using a vehicle. The annualized rate for Collision Damage Waiver ("CDW") under the agreement is up to $11,000 per year. The annualized rate for Supplemental Liability Protection ("SLP") under the agreement is up to $4,727 per year. The purchase of CDW, SLP, or any of your other insurance options is not required to rent a vehicle.

    DISTRICT OF COLUMBIA RENTALS: "Warning - failure to return this vehicle in accordance with the terms of this rental agreement may result in a criminal penalty of up to 3 years in jail." Pursuant to DC ST § 50-1703(d), the operator of a motor vehicle shall not transport any child under 16 years of age unless the child is properly restrained in an approved child safety restraint system or restrained in a seat belt. Children under 8 years of age shall be properly seated in an installed infant, convertible (toddler) or booster child safety seat, according to the manufacturer's instructions. A booster seat shall only be used with both a lap and shoulder belt. A parent or legal guardian may transport his or her own child without restraint herein if that person is transporting a number of his or her own children of less than 16 years of age which exceeds the number of passenger positions equipped with safety belts in the motor vehicle. However, an unrestrained child may not be transported in the front seat of a motor vehicle.

    FLORIDA RENTALS: "The valid and collectible liability insurance and personal injury protection insurance of any authorized rental or leasing driver is primary for the limits of liability and personal injury protection coverage required by ss. 324.021(7) and 627.736, Florida statutes."

    FAILURE TO RETURN RENTAL PROPERTY OR EQUIPMENT UPON EXPIRATION OF THE RENTAL PERIOD AND FAILURE TO PAY ALL AMOUNTS DUE (INCLUDING COSTS FOR DAMAGE TO THE PROPERTY OR EQUIPMENT) ARE EVIDENCE OF ABANDONMENT OR REFUSAL TO REDELIVER THE PROPERTY, PUNISHABLE IN ACCORDANCE WITH SECTION 812.155 AND/OR SECTION 817.52 OF THE FLORIDA STATUTES.

    You waive your right to receive a Miami Dade County Visitor Information Map at the time this agreement is executed.

    Personal Injury Protection and Uninsured/Underinsured Motorist Protection. Except as required by law, National does not provide Personal Injury Protection, No Fault Benefits or Medical Payment Coverage (collectively PIP) or Uninsured/Underinsured Motorist Protection (UM/UIM) through this Agreement. If National is required by law to provide PIP and/or UM/UIM, Renter expressly selects such protection in the minimum limits with the maximum deductible and expressly waives and rejects PIP and/or UM/ UIM limits in excess of the minimum limits required by law.

    All parties seeking PIP or UM/UIM benefits, including their purported assignors, must complete an Application for PIP Benefits on a form provided by National as soon as practicable following the alleged loss. Furthermore, all parties seeking PIP or UM/UIM benefits, including their purported assignors, must fully cooperate with National and its representatives in its investigation into the loss. Such cooperation includes, but is not limited to, the obligation to submit to an Examination Under Oath, Independent Medical Examinations, as well as the provision of recorded statements and written statements. Cooperation with National’s investigation is a condition precedent to receiving PIP benefits from National. Notice Pursuant to F.S. 627.736(5)(a)5, National hereby places all potential Personal Injury Protection (PIP) claimants on notice, per the terms of Florida’s No-Fault Law, that National will limit payment pursuant to the schedule of charges specified in paragraph (5)(a)1 of F.S. 627.736.

    HAWAII DISCLOSURE NOTICE: By entering into this agreement, you acknowledge that you may be responsible for all damage to the vehicle even if someone else caused it or the cause is unknown. You may be responsible for the cost of repair up to the value of the vehicle, and towing, storage, impound fees and other costs related to such damage. The agreement offers, for an additional charge, an optional collision damage waiver to cover your responsibility for damage to the vehicle, provided, however, to the extent permitted by applicable law, the collision damage waiver will not protect you from damage arising from a prohibited use (described below). Before deciding whether to purchase the collision damage waiver, you may wish to determine whether your own vehicle insurance affords you coverage for damage to the vehicle and the amount of the deductible under your own insurance coverage. You should consult with your insurer to determine the scope of your own insurance coverage. The purchase of this collision damage waiver is not mandatory and may be waived. The daily cost of collision damage waiver is up to $26.99 per day. By renting this vehicle you acknowledge that you understand the provisions of this paragraph including that such damage waivers are optional and entail an additional charge, that you may already be covered by your own insurance, that you may be responsible for damages occurring to the vehicle, and that the actual daily charge is included in this agreement.

    THE FOLLOWING SHALL INVALIDATE CDW:
    a. if Vehicle is damaged when used or driven:
      (1) by any person other than Renter or AAD(s) without National's prior written consent;
      (2) by any person if there is reasonable evidence the driver was impaired by the use of alcohol, narcotics, intoxicants, or drugs, used with or without a prescription;
      (3) by any person committing a felony or otherwise engaged in a criminal act;
      (4) in a race or speed contest;
      (5) to tow or push anything;
      (6) outside the states authorized on Page 1;
      (7) under authority of any driver's license that is suspended, revoked, invalid or does not belong to the driver;
      (8) to transport persons or property for hire;
      (9) in a wanton or reckless manner or if Vehicle is deliberately damaged;
      (10) on an unpaved road or off road;
      (11) to transport explosives, chemicals, corrosives or other hazardous materials or pollutants of any kind; or

    b. if Renter misrepresents facts to National pertaining to rental, use, or operation of Vehicle; or
    c. if Vehicle's interior components are stolen or damaged when Vehicle is unlocked or keys are not secured; or
    d. if Renter fails or refuses to provide National, police, or other authorities with a full report of any accident or vandalism involving Vehicle or otherwise fails to cooperate with National, police, or other authorities in the investigation of any accident or vandalism.
    e. if Vehicle is stolen and Renter fails to do any of the following:
      (1) return the original ignition key and National's key tag identifying Vehicle;
      (2) file a police report within 24 hours after discovering the theft;
      (3) cooperate fully with National, police and other authorities in all matters connected with the investigation of the theft.

    INDIANA DISCLOSURE NOTICE: 1. LDW is optional. 2. LDW entails an additional charge. 3. The additional charge per day for LDW is listed in the rental agreement. 4. All benefits of, and actions that invalidate, LDW are in Paragraph 16. 5. The renter or other authorized driver may already be sufficiently covered for damage to Vehicle and should examine the renter's or authorized driver's automobile insurance policy to determine whether the policy provides coverage for damage, loss, or loss of use to a rented vehicle, and the amount of the deductible. 6. By entering into the agreement, the renter may be liable for damage, loss, or loss of use to the rental vehicle. By renting this vehicle you acknowledge that you understand that such damage waivers are optional and entail an additional charge, that you may already be covered by your own insurance, that you may be responsible for damages occurring to the vehicle, and that the actual daily charge is included in this agreement. Also, damages for which Renter is responsible include but are not limited to: loss of use regardless of fleet utilization if the vehicle if the vehicle is repaired (total labor hours from the repair estimate divided by 4, multiplied by the daily rate on Page 1, multiplied by 80%), claim administrative fees (10% of the repair estimate up to the first $1500, plus an additional 7.5% fee for any amount over $1500), towing, storage or impound fees, and other costs incurred by National to recover Vehicle and to establish damages.

    ILLINOIS DISCLOSURE: This contract offers, for an additional charge, a collision damage waiver to cover your financial responsibility for damage to the rental vehicle. The purchase of a collision damage waiver is optional and may be declined. You are advised to carefully consider whether to sign this waiver if you have rental vehicle collision coverage provided by your credit card or collision insurance on your own vehicle. Before deciding whether to purchase the collision damage waiver, you may wish to determine whether your own vehicle insurance affords you coverage for damage to the rental vehicle and the amount of the deductible under your own insurance coverage

    Subject to the limitations set forth in Section 6-305.2 of the Illinois Vehicle Code, which limits the Renter's liability for loss, damage, or theft of the vehicle to the actual and reasonable costs to the National for the repair of the Vehicle, or the fair market value of the Vehicle, whichever is less, Renter accepts responsibility for damage to, loss or theft of, Vehicle or any part or accessory, including and without limitation tires and tools, regardless of fault or negligence of Renter or any other person or act of God. Under Section 6-305.2 of the Illinois Vehicle Code, the maximum amount the National may recover for loss or damage of the vehicle is $15,000 up until May 31, 2012. Thereafter, this amount is subject to an annual increase of $500 on June 1 of each year thereafter. Renter shall pay National the amount necessary to repair the damaged Vehicle, subject to the aforementioned limitations. If the National determines the Vehicle is salvage, Renter shall pay National the fair market value less any sale proceeds, subject to the aforementioned limitations in Section 6-305.2. For purposes of this Agreement, fair market value shall be the retail value of the Vehicle immediately preceding the loss. Liability for theft of the Vehicle is limited to $2,000 except if the Renter or AAD(s) fails to exercise reasonable care while in possession of the Vehicle or the Renter or AAD(s) commits, aids or abets the theft of the Vehicle, the Renter is responsible for the actual and reasonable cost of the Vehicle, up to its fair market value, subject to the aforementioned limitations in Section 6-305.2. If Vehicle is returned during non-business hours or to any place other than the Branch Address on Page 1, any damage to, loss or theft of, Vehicle or Optional Accessories occurring prior to an employee of National checking in Vehicle is Renter's responsibility.
    CDW will be voided for one or more of the following reasons:
      a. Damage or loss while the rental vehicle is used to carry persons or property for a charge or fee.
      b. Damage or loss during an organized or agreed upon racing or speed contest or demonstration or pushing or pulling activity in which the rental vehicle is actively involved.
      c. Damage or loss that could be reasonably expected from an intentional or criminal act of the driver other than a traffic infraction.
      d. Damage or loss to any rental vehicle resulting from any auto business operation, including but not limited to repairing, servicing, testing, washing, parking, storing, or selling of automobiles.
      e. Damage or loss occurring to a rental vehicle if the rental contract is based on fraudulent or material misrepresentation by the renter.
      f. Damage or loss arising out of the use of the rental vehicle outside the continental United States when such use is specifically prohibited in the rental agreement.
      g. Damage or loss occurring while the rental vehicle is operated by a driver not permitted under the rental agreement.
      h. Damage or loss occurring while the rental vehicle is operated by a driver under the influence of alcohol, other drug or drugs, intoxicating compound or compounds, or any combination thereof and convicted of violating subsection (a) of Section 11-501 of the Illinois Vehicle Code.

    IOWA: Notice this contract offers, for an additional charge, a collision damage waiver to cover all or part of your responsibility for damage to the rental vehicle. Before deciding whether to purchase the collision damage waiver, you may wish to determine whether your own automobile insurance affords you coverage for damage to the rental vehicle and the amount of the deductible under your own insurance coverage. The purchase of this collision damage waiver is not mandatory and may be declined.

    KANSAS: This contract offers, for an additional charge, a collision damage waiver to cover your responsibility for damage to the vehicle. Before deciding whether to purchase the collision damage waiver, you may wish to determine whether your own automobile insurance affords you coverage for damage to the rental vehicle and the amount of the deductible under your own insurance coverage. The purchase of this collision damage waiver is not mandatory and may be waived.

    LOUISIANA DISCLOSURE NOTICE: IF YOU HAVE COLLISION COVERAGE UNDER YOUR OWN AUTOMOBILE INSURANCE POLICY WRITTEN IN LOUISIANA, YOUR COLLISION COVERAGE AUTOMATICALLY EXTENDS TO RENTAL MOTOR VEHICLES PURSUANT TO R.S. 22:1296.
    EVEN IF YOU ARE NOT A LOUISIANA INSURED, THE PURCHASE OF COLLISION DAMAGE WAIVER IS NOT MANDATORY AND MAY BE WAIVED. THIS CONTRACT OFFERS, FOR AN ADDITIONAL CHARGE, A COLLISION DAMAGE WAIVER TO COVER YOUR RESPONSIBILITY FOR DAMAGE TO THE VEHICLE. BEFORE DECIDING WHETHER TO PURCHASE THE COLLISION DAMAGE WAIVER, YOU MAY WISH TO DETERMINE WHETHER YOUR OWN AUTOMOBILE INSURANCE AFFORDS YOU COVERAGE FOR DAMAGE TO THE RENTAL VEHICLE AND THE AMOUNT OF THE DEDUCTIBLE UNDER SUCH COVERAGE.

    MARYLAND : Notice: this contract offers, for an additional charge, a collision damage waiver to cover your responsibility for damage to the automobile. Before deciding whether to purchase the collision damage waiver, you may wish to determine whether your own automobile insurance affords you coverage for damage to the rental automobile and the amount of the deductible under your own insurance coverage. The purchase of this collision damage waiver is not mandatory and may be waived. Maryland law requires that all Maryland residents' insurance policies with collision coverage automatically extend that collision coverage to passenger cars rented by the insureds named in the policy for a period of 30 days or less. You may not need the automobile insurance offered by National. Your automobile insurance policy may provide coverage for your liability while operating a rental vehicle. You should check the terms and conditions of your automobile insurance policy to determine if coverage is provided for the rental. The purchase of insurance is not required as a condition of renting an automobile. In addition, if you are driving the rental vehicle due to an accident or repairs, state law may require your personal automobile liability policy to provide coverage and purchase of any excess liability coverage may duplicate coverage required by law to be provided by the owner(NATIONAL) of the rental vehicle.

    If vehicle is a replacement vehicle as defined in Section 17-104 of the Maryland Transportation Code, the liability insurance coverage on the vehicle being replaced (renter's/driver's vehicle) is primary, and any liability coverage owner(NATIONAL) provides on vehicle is secondary.

    MASSACHUSETTS DISCLOSURE NOTICE: This contract offers, for an additional charge, a collision damage waiver to cover your financial responsibility for damage to the rental vehicle. Your personal automobile insurance may already cover you for damage to a rental car. The purchase of a collision damage waiver is optional and may be declined. For Massachusetts' drivers: if you have an automobile policy on your personal vehicle with coverage for collision, your policy will cover collision damage to a rental vehicle, less the deductible on your policy. If you have comprehensive coverage on your vehicle, your policy will cover loss on the rental vehicle caused by fire, theft or vandalism, less the deductible on your policy. Drivers who hold policies in other states should check with their insurance agents to determine whether their policies extend to rental vehicles.

    If a collision damage waiver is purchased in Massachusetts, only the following may be excluded from the protection of the collision damage waiver:
      (a) damage or loss caused intentionally, willfully or wantonly by an authorized driver;
      (b) damage or loss occurring while an authorized driver operates the rental vehicle while legally intoxicated or under the influence of any illegal drug or chemical as defined or determined under the law of the state in which the damage occurred;
      (c) damage or loss caused while an authorized driver is engaging in any speed contest;
      (d) damage or loss caused while an authorized driver is using the vehicle to push or tow anything or using the vehicle to carry persons or property for hire, unless expressly authorized in the rental agreement;
      (e) damage or loss incurred while an authorized driver is driving outside the United States or Canada, unless expressly authorized in the rental agreement;
      (f) damage or loss incurred while the vehicle is driven, with the renter's permission or accession, by anyone other than an authorized driver;
      (g) damage or loss incurred after the private passenger automobile was rented or an authorized driver was approved as a result of fraudulent information provided to the rental company;
      (h) damage or loss incurred as a result of commission of a felony by an authorized driver.


    MICHIGAN: SECTION 257.401 OF THE MICHIGAN COMPILED LAWS PROVIDES THAT THE RENTAL VEHICLE OWNER (NATIONAL) IS LIABLE ONLY UP TO $20,000 BECAUSE OF BODILY INJURY OR DEATH TO ONE PERSON IN ANY ONE ACCIDENT AND $40,000 BECAUSE OF BODILY INJURY OR DEATH TO TWO OR MORE PERSONS IN ANY ONE ACCIDENT, AND ONLY IF THE RENTED VEHICLE IS OPERATED BY THE RENTER, OTHER AUTHORIZED DRIVER, OR BY THE RENTER'S SPOUSE, FATHER, MOTHER, BROTHER, SISTER, SON, DAUGHTER, OR OTHER IMMEDIATE FAMILY MEMBER. AND, THAT THE RENTER MAY BE LIABLE TO THE OWNER(NATIONAL) UP TO THESE AMOUNTS AND TO AN INJURED PERSON FOR AMOUNTS AWARDED IN EXCESS OF THESE AMOUNTS.

    THIS CONTRACT OFFERS, FOR AN ADDITIONAL CHARGE, THE FOLLOWING OPTIONAL PRODUCTS: DAMAGE WAIVER; PERSONAL ACCIDENT INSURANCE; ROADSIDE ASSISTANCE PROTECTION AND SUPPLEMENTAL LIABILITY PROTECTION. BEFORE DECIDING WHETHER TO PURCHASE ANY OF THESE PRODUCTS, YOU MAY WISH TO DETERMINE WHETHER YOUR PERSONAL INSURANCE OR CREDIT CARD PROVIDES YOU COVERAGE DURING THE RENTAL PERIOD. THE PURCHASE OF ANY OF THESE OPTIONAL PRODUCTS IS NOT REQUIRED TO RENT VEHICLE.

    MINNESOTA CONSUMER PROTECTION NOTICE:

    You do not have to make any payments to National for damage to the Vehicle prior to payment by your insurer for such damage if your insurance was issued in Minnesota, so long as payment by your insurer is made within the time limits provided by Minnesota Statutes Section 72A.201


    UNDER MINNESOTA LAW, A PERSONAL AUTOMOBILE INSURANCE POLICY MUST: (1) COVER THE RENTAL OF THIS MOTOR VEHICLE AGAINST DAMAGE TO THE VEHICLE AND AGAINST LOSS OF USE OF THE VEHICLE; AND (2) EXTEND THE POLICY'S BASIC ECONOMIC LOSS BENEFITS, RESIDUAL LIABILITY INSURANCE, AND UNINSURED AND UNDERINSURED MOTORIST COVERAGES TO THE OPERATION OR USE OF A RENTED MOTOR VEHICLE. THEREFORE, PURCHASE OF ANY COLLISION DAMAGE WAIVER OR SIMILAR INSURANCE AFFECTED IN THIS RENTAL CONTRACT IS NOT NECESSARY. IN ADDITION, PURCHASE OF ANY ADDITIONAL LIABILITY INSURANCE IS NOT NECESSARY IF YOUR POLICY WAS ISSUED IN MINNESOTA UNLESS YOU WISH TO HAVE COVERAGE FOR LIABILITY THAT EXCEEDS THE AMOUNT SPECIFIED IN YOUR PERSONAL AUTOMOBILE INSURANCE POLICY.

    MISSOURI DISCLOSURES: Collision damage waiver and car rental insurance notice: our contract offers for an additional charge collision damage waiver and car rental insurance products. Before deciding whether to purchase any of these optional products, you may wish to determine whether your personal insurance or credit card provides you coverage during the rental period. The purchase of any of these optional products is not required to rent a vehicle.

    National collects a vehicle licensing and registration recovery fee in Missouri, often called Vehicle License Recovery Fee or "VLRF", which is the per rental day recovery of National's average annual cost to tag, title, pay taxes on, and/or register its fleet registered in the state of Missouri.

    A "Surcharge" at the rate shown on Page 1 of this Agreement [or your National Car Rental reservation confirmation], calculated as a percentage of the daily rental time, mileage and drop charges incurred by Renter [You]. The Surcharge represents a portion of the total fees, expenses and impositions Owner [National], in good faith, estimates it has paid or incurred, or expects to pay or incur, for or with respect to Owner's [National's] Missouri fleet of daily rental vehicles for state and local personal property and sales taxes, fees and assessments; vehicle licensing, titling, registration and documentation; emissions inspections; any similar or related fees, expenses or impositions; and overhead expenses related to any of the foregoing. The Surcharge charged to Renter [You] will not necessarily equal a portion of the actual fees, expenses and impositions paid or incurred, by Owner [National] for or with respect to the particular vehicle rented; rather, the Surcharge is based on Owner's [National's] good faith allocation to this rental of a per rental day portion of the total fees, expenses and impositions Owner [National] estimates in good faith it has paid or incurred or expects to pay or incur in the current calendar year with respect to its Missouri fleet of daily rental vehicles.

    NEVADA DISCLOSURE NOTICE: Nevada law requires any driver of a passenger car and any passenger 5 years of age or older who rides in the front or back seat of a passenger car to wear a safety belt if one is available for his seating position.

    Renter accepts responsibility for damage to, loss or theft of, Vehicle, Optional Accessories or any part or accessory regardless of fault or negligence of Renter or any other person or act of God to the maximum extent permitted by Nevada law. Renter shall not have Vehicle or Optional Accessories repaired without permission from National. Renter shall pay National the amount necessary to repair Vehicle or Optional Accessories. However, if Vehicle is stolen and not recovered or National determines Vehicle is salvage, Renter shall pay National the fair market value less any sale proceeds. If Optional Accessories are not returned, Renter shall pay National the fair market value of the Optional Accessories. Renter acknowledges that: (a) Renter's responsibility for loss or damage to the Vehicle will not exceed the fair market value of Vehicle at the time Vehicle is lost or damaged plus actual towing, storage and impound fees, an administrative charge and loss of use (if National determines Vehicle is repairable, loss of use shall be total labor hours from the repair estimate divided by 8, multiplied by the daily rate on Page 1. If the vehicle is stolen and not recovered or National determines Vehicle is salvage, loss of use shall be 15 days); (b) Renter's responsibility for damage to the Vehicle and loss of use of Vehicle resulting from vandalism not related to the theft of the Vehicle and not caused by Renter will not exceed $2500; and (c) Renter is not responsible for loss of or damage to Vehicle resulting from theft or vandalism related to the theft if Renter has possession of the ignition key or Renter establishes that the ignition key was not in Vehicle at the time of the theft, Renter files an official report of the theft with the police within 24 hours of learning of the theft and Renter cooperates with National and the police in providing information regarding the theft, and neither Renter nor an AAD(s) committed or aided and abetted the commission of the theft. If Vehicle is returned during non-business hours or to any place other than the original rental location, any damage to, loss or theft of, Vehicle or Optional Accessories occurring prior to an employee of National checking the Vehicle is Renters responsibility.
    THE FOLLOWING INVALIDATE DW:
    a. Damage or loss resulting from:
      (1) the intentional, willful, wanton or reckless conduct of Renter or AAD(s);
      (2) operation of the Vehicle by Renter or an AAD(s) while under the influence of drugs or alcohol in violation of the laws of the state in which the loss or damage occurs;
      (3 Renter or AAD(s) using the Vehicle to tow or push anything; or
      (4) operation of the Vehicle by Renter or AAD(s) on an unpaved road if the damage or loss is a direct result of the road or driving conditions;
      (5) Damage or loss resulting from:
      theft of the passenger car if committed by an authorized driver or a person aided or abetted by an authorized driver. A theft is presumed to have been committed by a person other than an authorized driver or a person aided or abetted by an authorized driver if the short-term lessee of the car:
      (a) Has possession of the ignition key furnished by the lessor or establishes that the ignition key furnished by the lessor was not in the car at the time of the theft; and
      (b) Files an official report of the theft with an appropriate law enforcement agency within 24 hours after learning of the theft and cooperates with the lessor and the law enforcement agency in providing information concerning the theft. The lessor may rebut the presumption set forth in this subsection by establishing that an authorized driver committed or aided and abetted another person in the commission of the theft.

    b. Damage or loss occurring when the Vehicle is:
      (1) used for hire;
      (2) used in connection with conduct that constitutes a felony;
      (3) involved in a speed test or contest or in driver training activity;
      (4) OPERATED BY A PERSON OTHER THAN YOU OR AAD(s), or
      (5) operated in a foreign country or outside the States of Nevada, Arizona, California, Idaho, Oregon and Utah, unless this Agreement expressly provides that the Vehicle my be operated in other locations; or

    c. If the Vehicle was rented as a result of fraudulent information provided to National by Renter or an AAD(s) or as a result of false information provided to National by Renter or an AAD(s) if National would not have rented the Vehicle if it had received true information.

    NEW MEXICO AND TENNESSEE PERSONAL INSURANCE DISCLOSURE: You may be covered for the claims covered by on your personal motor vehicle insurance policy. If such coverage exists under your personal motor vehicle insurance policy and such coverage is confirmed, you may require us to submit any claims for damage to your insurance carrier as your agent.

    NEW YORK DISCLOSURE NOTICES: This contract offers, for an additional charge, optional vehicle protection to cover your financial responsibility for damage or loss to the rental vehicle. The purchase of optional vehicle protection is optional and may be declined. You are advised to carefully consider whether to purchase this protection if you have rental vehicle collision coverage provided by your credit card or automobile insurance policy. Before deciding whether to purchase optional vehicle protection, you may wish to determine whether your credit card or your vehicle insurance affords you coverage for damage to the rental vehicle and the amount of deductible under such coverage. You have additional rights and responsibilities under ? 396-z of the laws of New York.

    Even if you purchase CDW in New York, You will still be held responsible if:

    1. the damage or loss is caused intentionally or as a result of willful, wanton or reckless conduct of the driver;

    2. damage or loss arises out of the driver's operation of the vehicle while intoxicated or impaired by the use of alcohol or drugs;

    3. National entered into the rental based on fraudulent or materially false information provided by you or another Authorized Driver;

    4. the damage or loss arises out of use of the Vehicle while engaged in the commission of a crime other than a traffic infraction;

    5. the damage or loss arises out of the use of the Vehicle to carry persons or property for hire, to push or tow anything, while engaged in a speed contest, operating off-road or for driver's training;

    6. the damage or loss arises out of the use of the Vehicle by a person other than an Authorized Driver or the authorized driver's duly licensed parent or child over the age of 18 who permanently resides in the same household as the authorized driver; or a parking valet or parking garage attendant for compensation and in the normal course of employment;

    7. the damage or loss arises out of the use of the Vehicle outside of the United States and Canada, unless the agreement authorizes travel elsewhere or;

    8. the authorized driver has failed to report the damage or loss to National as set forth by New York law. If the Vehicle is damaged, you have a right to inspect it within specified time limits.

    ATTENTION : National purchases no third-party insurance covering this rental, but provides its renters and authorized drivers with minimum liability coverage, as required by the New York Vehicle and Traffic Law. Those coverages are: $25,000 per accident for bodily injury to one individual/$50,000 per accident for bodily injury to more than one individual; $50,000 per accident for the death of one individual/$100,000 per accident for the death of more than one individual; $10,000 per accident for injury to or destruction of property. In addition, to the extent required by law, National will defend the renter and authorized drivers from all claims of third parties alleging bodily injury, death or property damage arising out of the operation of the rental vehicle. If additional liability coverage is desired you may purchase Supplemental Liability Insurance or SLI Coverage from National at an additional cost.


    NORTH CAROLINA: This contract offers, for an additional charge, Damage Waiver; Personal Accident Insurance/PERSONAL EFFECTS COVERAG E; Roadside Assistance Protection and Supplemental Liability Protection. Before deciding whether to purchase any of these products, you may wish to determine whether your personal insurance or credit card provides you coverage during the Rental Period. The purchase of any of these optional products is not required to rent Vehicle.

    A 1.5% city, and/or 1.5% county, tax maybe charged on the total lease or rental gross receipts (excluding highway use tax and other legal exclusions), as a tax on gross receipts.


    OREGON DISCLOSURE NOTICE: Our contracts offers, for an additional charge, a collision damage waiver to cover your responsibility for damage to the vehicle. Before deciding whether or not to purchase the collision damage waiver, you may wish to determine whether your own vehicle insurance affords you coverage for damage to the rental vehicle and the amount of the deductible under your own insurance coverage. The purchase of this collision damage waiver is not mandatory and may be waived.

    PENNSYLVANIA REJECTION OF UNINSURED MOTORIST PROTECTION: In the event you intend to reject uninsured motorist coverage or any policy of insurance or self-insurance issued under this Emerald Club Master Rental Agreement, you are required to review the following Disclosure:

    As used in this disclosure, the terms "I," "my," "myself," and "me" mean the renter signing the agreement I am rejecting uninsured motorist coverage under this rental or lease agreement, and any policy of insurance or self-insurance issued under this agreement, for myself and all other passengers of the vehicle. Uninsured coverage protects me and other passengers in the vehicle for losses and damages suffered if injury is caused by the negligence of a driver who does not have any insurance to pay for losses and damages.

    RHODE ISLAND ADDITIONAL DISCLOSURE NOTICE: This contract offers, for an additional charge, a collision damage waiver to cover your responsibility for damage to the vehicle. Before deciding whether to purchase the collision damage waiver, you may wish to determine whether your own automobile insurance affords you coverage for damage to the rental vehicle and the amount of the deductible under your own insurance coverage. The purchase of this collision damage waiver is not mandatory under this contract.

    Read the collision damage waiver disclosure provision contained in this agreement before signing this agreement.

    Notice about liability for damage to the rental car. The state of Rhode Island requires us to provide the following information about your liability for damage to the rental car and the purchase of a damage waiver. Insurance or credit card coverage. Liability for any damage to the rental vehicle may be covered by your personal insurance policy or credit agreement. Check your insurance policy or credit agreement about coverage. Damage waiver coverage. A damage waiver is not insurance coverage. You do not have to purchase the collision damage waiver. You can decline it. If you purchase a damage waiver, we will waive our right to hold you or any authorized driver liable for damage. Even if you buy the damage waiver, you and any authorized driver will remain liable for damage if any of the following apply: (1) damage or loss caused intentionally, willfully or wantonly by any authorized driver; (2) damage or loss occurring while an authorized driver operates the rental vehicle while legally intoxicated or under the influence of any illegal drug or chemical as defined or determined under the law of the state in which the damage occurred; (3) damage or loss caused while an authorized driver is engaged in any speed contest; (4) damage or loss caused while an authorized driver is using the vehicle to push or tow anything or using the vehicle to carry persons or property for hire unless expressly authorized in the rental agreement; (5) damage or loss incurred while an authorized driver is driving outside the United States or Canada, or, if state restrictions are imposed by the rental agreement if such damage or loss is incurred outside of those states where operation of the vehicle is expressly authorized in the rental agreement; (6) damage or loss incurred while the vehicle is driven, with the renter's permission or accession, by anyone other than an authorized driver; (7) damage or loss incurred after the private passenger automobile was rented or an authorized driver was approved as a result of fraudulent information provided to the rental company; (8) damage or loss incurred as a result of commission of a felony by an authorized driver; and (9) damage or loss incurred if the vehicle is stolen and the renter or authorized driver fails to return the original ignition key, fails to file a police report within seventy-two (72) hours of discovering the theft, or fails to cooperate with the rental agency, police or other authorities in all matters connected with the investigation."

    The liability insurance of any driver or lessee of the vehicle rented under this contract is primary as required by R.I.G.L. 31-34-4.

    SOUTH CAROLINA NOTICE: As required by § 56-31-50 of the South Carolina Statutes, rental companies engaged in the business of renting private passenger motor vehicles or rental vehicles for periods of thirty-one days or less shall collect, at the time the vehicle or rental vehicle is rented in South Carolina, a five percent surcharge in each rental contract. For purposes of this section, a vehicle or rental vehicle is rented in South Carolina if it is picked up by the renter in South Carolina.

    THIS CONTRACT OFFERS, FOR AN ADDITIONAL CHARGE, THE FOLLOWING OPTIONAL PRODUCTS : DAMAGE WAIVER; PERSONAL ACCIDENT INSURANCE/PERSONAL EFFECTS COVERAGE; ROADSIDE ASSISTANCE PROTECTION AND SUPPLEMENTAL LIABILITY PROTECTION. BEFORE DECIDING WHETHER TO PURCHASE ANY OF THESE PRODUCTS, YOU MAY WISH TO DETERMINE WHETHER YOUR PERSONAL INSURANCE OR CREDIT CARD PROVIDES YOU COVERAGE DURING THE RENTAL PERIOD. THE PURCHASE OF ANY OF THESE PRODUCTS IS NOT REQUIRED TO RENT VEHICLE.


    TENNESSEE: PURCHASER OF THE INSURANCE COVERAGE, COLLISION DAMAGE WAIVER OR ROADSIDE ASSISTANCE PROTECTION MAY BE COVERED FOR SUCH CLAIMS ON THE PURCHASER'S PERSONAL MOTOR VEHICLE INSURANCE/PEC POLICY, AND IF SUCH INSURANCE COVERAGE EXISTS UNDER THE RENTER'S PERSONAL INSURANCE POLICY, AND THE COVERAGE IS CONFIRMED, THE RENTER MAY REQUIRE THE RENTAL CAR COMPANY TO SUBMIT ANY CLAIMS TO THE RENTER'S PERSONAL INSURANCE CARRIER AS THE RENTER'S AGENT. THE PURCHASE OF ANY OF THESE PRODUCTS IS OPTIONAL AND NOT REQUIRED TO RENT A VEHICLE.

    TEXAS DISCLOSURE NOTICE: Your rental agreement offers, for an additional charge, an optional waiver to cover all or a part of your responsibility for damage to or loss of the vehicle. Before deciding whether to purchase the waiver, you may wish to determine whether your own automobile insurance or credit card agreement provides you coverage for rental vehicle damage or loss and determine the amount of the deductible under your own insurance coverage. The purchase of the waiver is not mandatory. The waiver is not insurance.
    Notice to Texas Residents Regarding Damage Waivers
    Your personal automobile insurance policy may or may not provide coverage for your responsibility for the loss of or damage to a rented vehicle during the rental term. Before deciding whether to purchase a damage waiver, you may wish to determine whether your automobile insurance policy provides you coverage for rental vehicle damage or loss. If you file a claim under your personal automobile insurance policy, your insurance company may choose to nonrenew your policy at your renewal date, but may do so only if you are at fault for the claim.

    UTAH DISCLOSURES: You violate Utah statute § 76-6-410.5 if any vehicle you rent is not returned within 72 hours of midnight on the return date specified for that rental. Such violation may subject you to imprisonment for up to 15 years and a fine of up to $10,000.00. Notice: your own vehicle insurance or credit card agreement may cover any damage or loss to the rental vehicle.

    VIRGINIA DISCLOSURE NOTICE: This contract offers, for an additional charge, a collision damage waiver to cover your responsibility for damage to the vehicle. Before deciding whether to purchase the collision damage waiver, you may wish to determine whether your own vehicle insurance affords you coverage for damage to the rental vehicle and the amount of the deductible under your own insurance coverage. The purchase of this collision damage waiver is not mandatory and may be waived.

    WASHINGTON DISCLOSURE: THE INSURANCE POLICIES OFFERED HEREIN MAY PROVIDE A DUPLICATION OF COVERAGE ALREADY PROVIDED BY YOUR PERSONAL AUTOMOBILE INSURANCE POLICY, YOUR HOMEOWNERS? POLICY, OR SOME OTHER POLICY YOU MAY OWN OR BE ENTITLED TO. NATIONAL CAR RENTAL IS NOT QUALIFIED TO EVALUATE THE ADEQUACY OF YOUR EXISTING INSURANCE COVERAGE. YOU ARE NOT REQUIRED TO PURCHASE INSURANCE FROM NATIONAL CAR RENTAL IN ORDER TO RENT A CAR FROM NATIONAL CAR RENTAL.

    WHAT IF YOU DAMAGE A RENTAL CAR?

    We Must Provide You With
    An Important Notice About Your
    Liability For Damage To A Rental Car

    A car rental company that offers "damage waivers" for a price must also provide each renter with a written notice before the renter signs a rental agreement (ATCP 118). The renter must sign the notice, which must be printed on a separate piece of paper in a specified format. The company must give the renter one copy and keep another copy for 6 years. The notice must look like this:

    NOTICE ABOUT LIABILITY FOR DAMAGE TO THE RENTAL CAR

    The State of Wisconsin requires us to provide the following information about your liability for damage to a rental car and the purchase of a damage waiver.

    LIABILITY FOR DAMAGE TO THE RENTAL CAR

    The rental agreement makes you and any authorized driver liable for any damage to the rental car caused by an accident or intentional, reckless or wanton misconduct. Total liability for any damage is limited to:
    1) reasonable repair costs, less discounts available to us, or the fair market value of the car, whichever is less, and

    2) actual and reasonable towing and up to two days storage costs.

    INSURANCE OR CREDIT CARD COVERAGE

    Liability for any damage may be covered by your personal insurance policy or credit card agreement. Check your insurance policy or credit card agreement about coverage.

    DAMAGE WAIVER COVERAGE

    A damage waiver is not insurance coverage. If you purchase a damage waiver for _____ per day, we will waive our right to hold you or any authorized driver liable for damage. Even if you buy a damage waiver, you and any authorized driver will remain liable for damage if any of the following apply:

    1) The damage is caused by you, or any authorized driver, intentionally or by reckless or wanton misconduct.

    2) The damage occurs while you, or any authorized driver, operates the car in this state while under the influence of an intoxicant or other drug, as described by the laws of this state.

    3) The damage occurs while you, or any authorized driver, operates the car in another state while under the influence of an intoxicant or other drug, as described by the laws of that state.

    4) The damage occurs while you, or any authorized driver, is engaged in a race, speed, or endurance contest.

    5) The damage occurs while you or any authorized driver is using, or has direct another to use, the car in the commission of a misdemeanor, or a felony, as defined by s. 939.60, Stats.

    6) The damage occurs while you, or any authorized driver, use the car to carry persons or property for hire.

    7) The damage occurs while you or any authorized driver is using the car outside the United States and Canada, unless use outside of these countries is permitted under the rental agreement.

    8) The damage occurs while the car is operated on a surface not intended for use by private passenger vehicles.

    9) You provide us misleading or false information in order to rent the car, which causes us to rent you the car when we would not have otherwise done so, or on terms to which we would not have otherwise agreed.

    10) You, or an authorized driver, who was operating the car when an accident occurred, fail to promptly report, to us and the police, the accident resulting in damage to the car.

    NOTICE OF RIGHT TO INSPECT DAMAGE

    If the car is damaged, we may not collect any amount for the damage unless you, or an authorized driver against whom we claim liability, have been promptly notified of your and your insurers' right to inspect the unrepaired car within two working days after we were notified of the damage. If you request, we must also give you copies of two estimates we have obtained from repair shops regarding any damage claim.
